However, this will not make you eligible for help to buy or first buyer stamp duty relief. You are not a first time buyer because you own a property in Spain.

A first time buyer is someone who does not own, and has never owned, a home anywhere in the UK or the world.

I think the OP is referring to the Help To Buy equity scheme rather than the ISA (as they refer to a 'scheme' and directly to an equity loan).(Page 8) though this doesn't change much.
Who can take part in the scheme?
It is open to all buyers seeking a new build home.

The property purchased must be your only residence. Help to Buy is
not available to assist buy-to-let investors or those who will own any
property other than their Help to Buy property after completing their
    purchase.

Think you should do your research on Spanish legislations rather than point fingers and assume.

... but you have contradicted yourself? You couldn't have put it more explicitly?

Right so clearly you have got the wrong end of the stick just like anotherjoe. When you are advised by solicitors in Spain regarding the process for inheriting or donating, then you are greeted with FEES. The taxes I am on about and the taxes that your somehow implying that I’m evading are referred to as non residents tax and council tax. These taxes have nothing to do with the fees involved in transferring a property over in Spain. Hence why I said they are affordable. Think before you make assumptions. Remind me of my ex.

It's a UK board. Why should anyone here be doing research on Spanish legislations?!

You are the one saying Spanish tax is "fair and reasonable" and then making a "fake" transfer of what plainly was not intended to be your house for some considerable time since it would be "beneficial cost wise"

Well you’re gonna hate the game which makes you pay extra stamp duty and precludes you from first time buyer bonuses! :)

Nope don’t think so as il be changing title deeds and going ahead with this scheme as I’ve been advised today and also negotiating stamp duty. Anyone else want to jump on the haters bandwagon?

Well, you're on a bit of a sticky wicket, then.

I refer to the UK Government website, which explicitly states the following:

A first time buyer is defined as an individual or individuals who have never owned an interest in a residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence.

Couple that with the fact that Money Saving Expert is Regulated and Authorised by the FCA, and is obligated to report instances of potential money laundering (which includes tax evasion), and you have most likely provided identification information as part of your registration, expect HMRC to come knocking as soon as they see a name matching yours claiming to be a FTB.

No I’m not a bit of a sticky wicket. As the helper to buy website clearly states that you must not own any other property at the time you buy your new home. Don’t tar everyone with the same brush, not everyone is a fraudster. I’ve come on this page for advice, I’ve clearly been told on numerous occasions that I need to transfer my name off before I apply for this scheme. Hence me clearly stating in a previous post. So don’t come on here with negative threats directed towards me regarding tax evasion, fraud etc because i am not doing that. Is there actually anyone decent on this forum who doesn’t assume and make accusations, Jesus. I can sleep peacefully at night.
