PPI Plevin

Sorry for yet another PPI question but looking for some clarification.

I have come across two letters addressed to my wife regarding a car she bought on finance in 2009 from Perry’s Motor Sales.

The first letter is from MAPFRE/ABRAXAS
RE: Credit Protection Insurance purchased from PERRYS MOTOR SALES LIMITED on 22 April 2009
It states account number details and the Direct Debit amount and date.

The second letter is from Perry’s themselves that says:
“Please find enclosed first payment for PPP on the car you purchased from us Perry’s Motor Sales. The remaining payments will be paid by standing order using the bank details provided. I will send you a letter confirming when the last payment is due from us”

This to me suggests my wife was sold PPI, although at no financial lost to her self, Perry’s must of gained some form of compensation greater than the monthly Direct Debit my wife was paying otherwise they wouldn’t of offered to pay those payments for her.

Does this fall under Plevin with a case to pursue and if so how do I go about it?

    You would out in a complaint to whoever sold it to her.

    However, their commission couldn't be greater than the amount she was paying, as that would be impossible.

    Credit protection could be GAP rather than PPI.

    Your post is unclear. It sounds as if you are saying that your wife claimed on the policy and a payout occured. Is that correct?

    No claim was made. It was taken with one hand and given back with the other. As previously said there was no financial loss to my wife but missed sold for the salesman’s gain surely.

    MAPFRE/ABRAXAS took monthly Direct Debits and Perry’s gave it back each month on a standing order.

    Is this Plevin?

    If your wife didnt pay anything then there is nothing to refund.

    As it was not built into the credit agreement, plevin does not apply.
