Partners ex still on the mortgage wanting half

the ex will be entitled to 50% of the equity, unless your partner can show that there was a mutual intention that the split should be different.
As others have said, while your partner may have been paying the mortgage, they presumably haven't been paying rent to the ex and probably the mortgage will have been less than the cost of renting a similar property would have been.
Of course, your partner could work out what the equity was as a % of the value of the house, when they split up, and offer a lump sum equal to 50% of that percentage of the current house value, to see whether the ex will accept that, but don't hold your breath.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
How do you come to the 23k figure?
He lived in the house for 8 years, if he paid half the mortgage for all that time, and paid in a share for the deposit, plus it likely gained value in that time then 23k seems incredibly low for his share. Then when you calculate how much he could have claimed from you for rent (half of the fair market value for the area) I'd say he's been pretty decent and now you and your partner are trying to have your cake and eat it, benefitting from his financial input but unwilling to pay him his fair share.
Ask yourself how you would want it calculated it if was your ex wanting to sell your home and only offer you such a small amount.0 -
