Deposit not protected

Moved out a month ago. Landlord blaming agent, agent won't be blamed. Had a great relationship with landlord for years and really just want our deposit back.

What's the best approach here?

    If you just want your deposit back just tell them that. If they give it you back it doesn't matter who didn't protect it.

    The buck will always stop with the LL its their responsibility to either protect or ensure the deposit is protected.

    Ultimately its the LL who should now return it to you and if they have an issue with the agent they need to take that further...not your battle to get involved with.

    Request the deposit back from the LL and set a time frame that's you think is reasonable...5 days ,7 days.

    Up to you if you want to then challenge the legalities.

    Contract is with Landlord. Ultimately he/she is responsible for returning it

    If that does not work:


    Letter Before Action claiming both the deposit and the penalty, followed by court action. See


    * Deposits: payment, protection and return

    You might be doing the landlord a favour by (nicely but firmly) emphasising that he is legally responsible for the tenancy and property. He can delegate tasks to an agent but their mistakes are legally his mistakes. Another tenant could shaft him down the line.

    Maybe print something out from the CAB website or similar reputable source? Clear but not confrontational since you had a good relationship. If that fails Letter Before Action.
