Changed position and reduced salary

I have been working overseas for nearly 4 years for my UK employer as part of an international assignment. The agreement expires in a few months time and it seems like I will be repatriated home.

Within the agreement there is no guarantee of a job when I return to UK, however it states "in the event of no suitable employment being available upon your return, normal severance terms will apply"

As the company is going through tough times (3 rounds of redundancies in the last 18 months), I have been offered a job at a reduced salary (25% less). If I reject the job am I entitled to redundancy payment?

    If you don't think that is suitable alternative and the company agree then they should make you redundant.

    Was it made clear before you went what would be used to determine the "weeks pay" should redundancy happen.

    What if the company believe it is a suitable alternative, how can I challenge it?

    The company have a severance policy of paying the absolute minimum statutory rate, so I won't be expecting anything above that!!

    If you don't accept the job offered and they refuse to pay redundancy, you will be treated as having resigned. You could try negotiating a better salary, but if no agreement......

    You need to do some maths calculations, but I doubt the redundancy payout would equal more than a few months salary in the new job. f you do not accept the job, we are talking about an Employment Tribunal, where there is no guarantee of you winning and it would be months before your case is heard.

    I would accept the job and when back in the UK, start looking for something better.
