    Hi,

    Thanks for your reply, I purchased the system as a sole trader, I scaled down my business over 10 years ago and transferred across to sole trader status as I am a simple one person set up.

    I am still a bit unsure of where I stand?
    Do I have a case to raise based on the company failing in their T&Cs and not repairing the equipment, tomorrow will be yet another attempt by them to repair it so that will be 4 attempts?
    How many attempts are permitted before enough is enough? How long is a piece of string?

    We haven't seen the T&Cs of the contract between yourself and the seller, so we can't say. Remember - you're not a consumer here, this was a B2B contract regardless of you being a Ltd company or a sole trader.

    Unless you can do a s.75 as shaun from Africa suggests, looks like it comes down to their T&Cs.


    If it's a bit of kit costing £12k plus and isn't working as it should, it might be worth considering seeking paid for legal advice. Some solicitors will offer a free 30 minutes consultation. If you don't already have a solicitor, 'phone around.


    Do you belong to a trade body or local business network where you could seek advice?

    How did you pay for the system? as it's possible that you might have S75 rights to help you if you made the purchase when you were a sole trader and some or all of the purchase was made by way of credit.

    That would be Section 75 of the Consumer Credit Act - the OP isn't a consumer, so I don't think that legislation applies in this situation.
    (Although I could be wrong, I often am.)

    I don't think your right about this. It's cropped up before and it has been pointed out (by unholyangel I think?) that it isn't necessarily restricted to consumers.
