car insurance fault (non fault) claim

HI I need some advise please, in august 2018 my house was burgled and my car was stolen, it was recovered the next day but was deemed a total loss to the tune of £7k, an offender has been identified cctv footage from our home and is due in crown court in December this year (overwhelming evidence but the tool has gone not guilty), my issue is that my insurance has doubled as a result as although it is not my fault the insurance company states it as a fault claim as there is no third party insurance to recover losses from, my insurance is set to be affected for the next 5 years, what if anything can I do to get this overturned to a non fault claim?

    Can you sue the offender? He is your third party.

    "Fault" in an insurance claim is effectively "who paid?". Having your business has cost your insurer £7k, because nobody's paid out for the damage to the car.

    So, yep, it's correct.

    Even if it was no-fault, then you'd still have to declare it for five years, so your base premium would go up, since you're a higher risk.

    Apart from cancelling the claim and giving back the £7000 then no - theft claims are theft claims regardless if the thief was caught and pleaded guilty.
