Welcome!
Hopefully you will have read NEWBIES PLEASE READ THESE FAQS FIRST and sent the SAR needed to see their and before the claim arrives.
Also read any Excel defence threads to get ahead. Search the forum for those words!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for coming back to me. Have been reading through all the threads, but am a bit confused. Will the SAR delay the CCJ process? Also should I include the details of my honest mistake in the SAR?
I’m in contact with the hotel at the moment trying to get them to speak to the local land owner to cancel the invoice/LBCCC.
Also in the LBC it says I have to respond by 13/0619.
Letter is dated 14/05/19 and was sent second class post.
No where does it mention a 14 day response deadline?
Sorry if I’m asking stupid questions. Just a bit overwhelmed by the amount of information on the forum.
Thanks!0 -
The SAR will not delay the CCJ process BUT have you actually received a claim form from Northampton CCBC or just a letter of claim? The SAR is to find all the data the PPC holds about you and try to work out what they are alleging you did wrong. Then you can compile a defence that counters their arguments. CCJ only kicks in AFTER court papers, attending court, losing and then failing to pay any judgment within the timescale set by the judge. If you follow the advice on the forum there is every chance that you will not lose.0

These are not fines, they are private invoices for the damage the PPC alleges they suffered when, allegedly, you breached a contract they allege you had agreed with them, we call them scams.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
But sending a SAR is the urgent thing (EMAIL IT NOW) and has nothing to do with the details of any mistake. Also in the LBC it says I have to respond by 13/06/19.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello - more help needed I’m afraid!
I emailed an SAR to Excel Parking as Coupon Mad previously advised on the 24th May and have Received no response to my request.
Then low and behold over the weekend I’ve received a claim form from Northampton Court.
I’ve been reading through some of the threads on this forum and note that some advice suggests sending an acknowledgment of the LBC within 14 days? So getting a bit paranoid I haven’t followed the correct process/protocols.
Any advice welcome, but am starting to get cold feet.
Hovering over the laptop trying to decide whether to complete acknowledgement of service or just pay and get it off my back.0 -
If you have a claim form, you are well beyond LBC, that should have come before the claim forms from Northampton. If you want to defend the claim, completing the AoS will give you additional time to prepare your defence. What is the issue date on the claim form?
If you have not received a reply to your SAR, you need to email the DPO at the PPC and inform them that they have failed in their duty to supply the data within 30 days and you are now contacting the ICO to report their failure.0 -
Hi
Thanks Le_Kirk for your previous email - as always much appreciated.
I’ve decided to defend the case and have duly completed the AoS.
I’ve also notified the DPO at the PPC regarding their failure to respond. I’ve logged a complaint with the ICO.
.....I’m starting to get my head above these acronyms now!!
I suppose now I better start trawling through other excel parking cases to build a defence.
Any advice on how to tackle Excel specifically would be very welcome.
I have to file my defence before the 15th August.
Many thanks!!0 -
What is the Issue Date on your Claim Form?
Did the Claim Form come from the County Court Business Centre in Northampton, or from somewhere else?0 -
Hi KeithP thanks for your message. The date on the claim form from Northampton is the 16th July.0
