Courtesy car damage insurance issues

    Thank you everyone for their replies. We really appreciate your time to respond.

    Is it normal they can claim off their own insurance? I know they hadn’t informed them they were using the car though. Would that be the best thing to do?

    Obviously it’s really upsetting for them as they only used it to drive to work and back which is about 5 miles and the car got damaged at the work place. so couldn’t get it repaired before returning it to Dealer. It the first time they taken it in for work and had a courtesy car before so very gutted about the damage but then to find out that they might not have been covered after has thrown the spanner in the works as to what the best thing to do now.

    Does your friend have cover for a courtesy car?

    She could only claim off her own insurance if she had arranged for them to cover her. I tis not a normal part of a policy.

    Any cover for driving another car would be third party only so would not cover damage to the car she was driving.
  • Thank you.checked the driver’s and they are not insured to drive other cars. Would anyone still go down their insurance? Would the term about not driving for a year be an issue while making the claim and cause trouble ? or just pay for the damage in cash (and also inform own insurance)?
  • If you believe the estimate for repair to be in the range of £1200, and the excess on the insurance is £1000, even if the insurance states it is for drivers who have held their licence for 12 months or more - go down the insurance route.

    Why? That £1200 quote is from the dealer themselves, at commercial rates. Their cost rate will be significantly lower than that, and if you've paid them £1000 they won't actually make a claim on their insurance, so that 12 months+ criteria becomes an irrelevance.

    On terms of the affect on their future premiums it will make no difference whether they go through the insurance or pay cash. Given paying out of their own pocket will be more expensive i would go through the dealer's insurance.

    That is of course assuming they get around the one year driving issue.

    If that is an issue then i would offer to pay the 1000 and point out tot the dealership that they should have picked up on that limitation and highlighted it to your friend.

    The dealer should have seen from her driving licence that she would not be covered by the insurance. SO, in effect, they allowed her to drive uninsured.
  • Thank you again, so you thibk first try the insurance and if they say no we can’t sue to the issue mention then say it was the dealer’s responsibility to make sure he was insured? What if they say well he signed the form that agreed to the terms.is there any legal terms we can use to say ultimately it was the dealer responsibility
