kept money since 03/07 where do I stand

On 19/3/07 I ordered a spare part from Accessories Direct total cost £21.41 (edit) advised a 3 week delivery was likely.

On 7/06/07 I rang to find out where my spare part was, (edit)again (strange) says the O/No. I quoted was not recognised, nore was my address or postcode, I found the date of the payment on my credit card statement and he then went on to give me a new order No. which is only one digit different to the old one (strange again) he also said that the delay was due to the company relocating from Holland to Turkey (strange as he already told me the O/No. was not recognised, he told me to expect an estimated delivery time of 4 weeks.

15/11/07 rang to find out what was happening, ( my delay has been due to a house/country move) they say, the part is no longer available and will reimburse me but want my credit card number which is no longer available as the bank have change the account to a different name and issued new cards with new numbers.

Not once has this company contacted me.

Basically, where do I stand, they have had my money since March - 9 months now and they tell me the part is no longer available, can I charge them resonable interest am I due any compensation, what are my rights??

I do hope that someone can help me.

Please edit your post so as not to give the name of the employee.

It seems that you have also been quite slow in chasing them up. As they are offering you your money back, I would just give them your card details and take the refund.
    Gone ... or have I?
  • Surely the fact that I have been, and I agree with you, slow in chasing this up, does not alter the fact that they have kept my money since March and have not sent one single communication to me, all I would like to know is where I stand legally on this, do I have some recourse, surely this company must be brought to some kind of justice to this practise to prevent the same kind of thing happening again to someone who is perhaps less able to remember to chase up after waiting such a long time.
Actually I would rather them keep the money and supply the goods, as the item in question is a glass fridge shelf and quite an important integral part.
I am looking forward to an answer to my question.

  • get on to the cc company and get your money back - simplest and most cost effective course of action (if they are unwilling to refund or supply the part that is). You could try for compensation (yay claim culture) but the fair ammount (inflation) would be a matter of pence and for time spent (minimum wage) if it took you more than 10 minutes extra saving your time.
