  • I wanted a higher fence put up as they said it can get out over it and told the dog warden they would do this,when i chased it up with the dog warden he said as its not council property he cant do anything but to contact the police as they can and because a person was harmed it was actually a police issue.

    Planning permission is required for a fence over 2 metres high so they cannot just increase the height,

    What about the adjoining neighbours who may object to having a high fence on one side of their garden?

    There are ways to prevent the dog jumping over by putting an inward sloping barrier along the top .

    Obviously, keeping the dog restrained while in the garden is their solution to the problem.
  • It takes seconds for a dog to escape through a door,ive had one lol. Maybe the slope is an idea my fence is about 6 foot and i think that is high enough,i know both their neighbours one side has kids and her daughter loves cats,is obsessed and always follows them about so she is very keen that the dog cannot get out and the other side has a small dog,since their dog is an ex hunting dog trained to kill small furries they are keen for something to prevent it getting out aswell. Do you know if the fact they have now had a visit from the police and its been logged as a crime if they would be prosecuted if they let anything like this happen again? Maybe that will be enough to make them ensure it doesnt get out again and if it did the dog may be seized. I think it very irresponsible to bring a dog with this ones history to an area full of children and small pets and surely the rescue centre they got it from should have made sure there was no chance of this kind of incident ever happening by visiting their home and checking out the local area? The neighbours i have spoke to are quite shocked this has been allowed.

    But a high fence would only be allowed in a back garden . No more than 1 metre high is allowed between a property and an adjoining road without planning permission.

    It is up to the Crown Prosecution Service whether to prosecute, not the police. They pass the details on but the Prosecution Service decide whether to take it to court.

    In a case locally where a dog was found straying after a dog control order had been given requiring it to be on a lead when out in public, the owner was fined.

    But, without knowing what the police said , no one can tell you what would happen.
  • I was not trying to prosecute,i just wanted an order or something to ensure it wouldnt happen again,even a warning but certainly they said the dog can escape the back garden and said they were going to fix it but havent so i wanted the police to get them to do it. The dog was out of control in a public place,it attacked in a private garden and had to be restrained even after we had left with our cat in had the taste of blood and was still aggressive trying to get away to attack more cats. That particular day my neighbours kids were away but normally they would have been in their garden and could have been seriously injured by this dog!
    Also the officer did not contact me after he spoke with the owners and dog warden,my friend wanted to give a statement as her daughter was there but he didnt ring her and he didnt speak with the neighbours whose garden it happened in and who had to restrain the dog till its owner came. He said in his email my daughter was hurt because she had hold of her cat (she didnt she tried to pick him up but the dog lunged and caught her) and its lucky she wasnt hurt,as if its her fault she got injured not the fact an aggressive dog got out and attacked her cat!!!
