Offset rule question

As I’ve successfully had some PPi payouts my partner decided to check out his. He has had an offer RBS for a credit card that he had arrears on (he and his ex sent some stuff to a debt management company years ago) They sent him the statement of the credit card at the time of the offer and the payment was made against the arrears. He also claimed for mid-sold PPi on bank loans with same company, he’s received an offer (he closed his account 10 years ago so didn’t actually think he would get an offer and can’t remember if there’s any arrears on this (mainly because his ex dealt with all the finances). Anyway, long story short, they’ve made an offer today and the paperwork terms and conditions does say that any payment “can “be offset against arrears, however, this time there isn’t any paperwork enclosed showing a statement of account with arrears on it. Does the company have to provide this before they would offset any payment? (apologies for any typos I’m typing this on my phone) and thanks in advance for any thoughts/advice.

If you want proof of the arrears then you can ask the Bank to provide it, but they are not under any legal obligation to provide such proof in order to offset.
Before any cheque is issued, there will be insolvency checks made to ensure there are no monies outstanding, so you'll only know when these are completed.0 -
Thank you, I wasn’t sure if they had to send a statement with the offer (similar to the credit card claim)0

That was simply a courtesy on the part of the credit card provider, not a legal requirement.Loopslou72 wrote: »I wasn’t sure if they had to send a statement with the offer (similar to the credit card claim)0
