Unfair charges from landlord

    Just don't pay: Realistically there's nothing he can do until end of tenancy, if then.

    Follow the complaints procedure as detailed on their website.

    My view is that whilst I agree with Artful that a payment date is a payment date the wording you have supplied from your contract "On or around" does leave an element of non definition,therefore it is reasonable to pay when you did and not be charged.


    Its good to see from the website that deposits are held with my deposits so a dispute could be raised if they decide to opt for a deposit deduction.

  • Oops! I didn't mean to leave the name of the LL in there, I wasn't sure if that would be bad form to name them! No harm done I guess.

    So I should just avoid paying and see what they do next?

    The student finance has been paid very late this year
    However it's another nice little earner for the letting agents.

    I may be being picky but the contract wording you quote refers to the charges in the welcome pack being payable ‘in the event of’ a list of things that don’t include late payment.

    I’d go along with the advice of others and ask them to justify the 45 quid and ask in writing by a proper letter. If they still don’t engage then dispute the deduction with the deposit service.

    For me, the biggest problem is that they are referring to the £45 as a fine. They don't have the power to fine you - only a court can fine you. Dispute it, and don't pay it.

    The landlord attempted to take the payment on 25 April
    Sorry, can you please just confirm that you definitely have those dates correct there?

    If so, then you do not really think you have a leg to stand on, do you?

    So do you pay by direct debit or standing order, I would hazard a guess that payment is made via standing order in which case you have pre authorised the payment for a certain date funds permitting. Your Landlord has no control over that you do. If it is indeed a direct debit then the LL would make a request for payment via the DD scheme.
