    And even if they could, I can't see that they've got any case. They've never been in a contractual relationship with the builder. They could only pursue anyone who told them it didn't have asbestos - but I presume they've never previously had a surveyor tell them that, or had a warranty from the sellers that it didn't.

    Several of the houses are owned by the original purchasers but I was thinking we would have a case against the builders if they had used and illegal product when the houses were being completed. However, the information provided by Section106 does seem to give them a get out clause. I really do think Bloor are a very poor builder, Our previous house was built and completed in Oct 91 and the standard of build was far superior to this one. We have just removed a wall between the kitchen and dining room (and the ceiling!!) and the wall consisted of three plasterboards glued together, no sign of any metal framework holding everything together which our previous house had. Tank in the loft which we had to get removed, staircase a complete joke with mismatched skirting etc. Lights not centered in the rooms. We are having a lot of work done in the house but this is a cost we could do without to be honest.

    No, you're never going to have a case against the builders about anything. Up to you to do your due diligence before buying I'm afraid.

    We had a survey done but asbestos in the artex wasn't picked up, possibly not looked for because it was outlawed by the time the house was built.
