Court Action for UK CPM Parking Ticket

  • Thanks for your response.

I received the notice of allocations around 4 weeks ago advising of the deadline too. Yeah I know, completely my own fault, I have had a very stressful year and the past few months haven't been easy.

There is no way I can get the documents to the court or the claimant in the next half an hour, the only thing I can do is email it although I don't have all the evidence together (I am just trying to find all the relevant exhibits to add) and then follow up with the hard copies. Or I could just deliver the hard copies tomorrow and be able to double check everything is complete.

What would you recommend? A complete WS late or a WS not proofed without all of the key exhibits late?
  • Hi All
I think I am almost there. Please can you help with the below questions to assist me in finalising my WS.

    1. Shall I send the signature of Jack Chapman to the SRA using a similar template as the one that was previously provided on here and add that as an exhibit to my WS along with the other signatures on here? I have compared the signature and it is identical.

    2. I have noticed that the car parking sign states that 'the staff have no influence over PCN's & in no circumstances will they mediate', however the T&C's between the client and UK CPM states that the client provides the photographic images to UK CPM and the client can request cancellation of a parking charge within 28 days, and longer periods incurring charges. Is this a point that can be argued as contradictory?

    3. The WS of UK CPM repeats 3 paragraphs in the document under the contract section which it also covers in other sections of the WS. Is this a common thing to do to argue under the different headings or would you suggest that this is evidence that indicates the robo-claim process with cutting and pasting the information?

    4. When claiming the loss of earnings do you have to provide proof of income within the WS?

    5. Can you advise where I obtain the evidence for the exhibits for the Caernarfon Case and the Britannia Parking Case. Maybe I am not being very bright here, but I found the links for the Britannia case but just wasn't sure what was relevant to include. Is it just this in bold that I include:
    COURT REPORT:
F0DP806M/F0DP201T BRITANNIA PARKING -v- Mr C and another
    - APPLICATION TO SET ASIDE STRIKE OUT ORDER - AT SOUTHAMPTON COURT BEFORE DISTRICT JUDGE GRAND - 10.30am 11/11/2019

Thanks in advance for any help.
