Pursing a limited company for bad work re small claims

We had a drive way installed by a limited company whom did the work not to a high standard. We have had no luck if correcting the work or recovering any costs. We have surveyed evidence that the whole drive way needs to start over. Has any one succeeded in making a claim against a limited company, how to do it and recovery the cost of the works??

First you will need a report of the defects, and 3 quotes to correct or re-do.
You will have to give the company chance to do it themselves first.
If you are going to make a claim remember it's the company and not a person who the claims has to go to at the registered office if Ltd
I am going through one at the minute but not a building company.. I started the claim in January through MCOL and still have no court date as yet so it is a long process0 -
Yes of course - this happens all the time....Has any one succeeded in making a claim against a limited company, how to do it and recovery the cost of the works??
You do it via the Moneyclaim online Small Claims track process unless it exceeds the limit (£100,000).
You quantify the loss by getting 3 quotes to put the problem right.0 -
Check to see if the company is still trading. If it has been dissolved or in liquidation then you may be throwing good money after bad as there will be no assets in the company to pay any judgement made against them. That's the point to always bear in mind, getting a judgement in your favour is the relatively easy bit. Getting the money stated on the judgement isn't.

What is the potential value of the claim?
As has been said, you can use MCOL to start the claim (once you’ve complied with the relevant pre-action protocol). The value will then dictate what track it is assigned to (and therefore the further costs and complexities you’ll face later down the line).
If you aren’t successful then you may also have to pay the company’s costs on top of your own.0
