Hello,
I have received a letter from Premier Park for a PCN dated 2015 at Berry Head car park.
It has now been handed to a company called BW Legal who are commencing legal action.
What should my next move be? Any advice appreciated.

They are obviously trying to scam you so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -

Most people use bargepole's concise defence examples from there, plus add some facts into an extra point or two such as those specific points of defence about Berry Head (byelaws, lack of keeper liability, no landowner authority, photos taken out on the road not inside the car park...).
Search the forum for keywords: Berry Head. We have loads of threads including a recent one last month that talked about the byelaws et al.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
