Credit Card Application Fraud - Capital One don't agree

Someone applied for a credit card in my name and I found out from an email from Capital One saying the application had been refused.
So I will yet again pose the same question:
WHY WOULD A FRAUDSTER USE YOUR REAL E-MAIL ADDRESS WHEN MAKING A FRAUDULANT APPLICATION FOR CREDIT IN YOUR NAME?First post so if I am in the wrong place please let me know and apologies! Desperate for advice here...
Someone applied for a credit card in my name and I found out from an email from Capital One saying the application had been refused. See comment above. Called their fraud dept who then called me back two days later and asked me some questions about my details - job, address, dob, email. They then asked me if I had ever lived at two addresses that I hadn't heard of.
The next day I received an email from Capital One saying that they have investigated and don't believe it was a fraudulent application and won't remove the record from my credit file. I called them back and they have advised I need to provide further information in order to prove I was not at the address on the application (and they won't tell me what that address was). Why? What has your being physically present at the address on the application got to do with anything?
I have sent them - electoral roll records for the last 3 years from Experian, a note from Experian stating my email and password have been leaked This leaking of your e-mail and password barely receives a mention. Are you saying that your e-mail and your e-mail password had been leaked? If so, by who? How could Experian possibly know or confirm this? Or are you saying that your e-mail address and Experian password had been leaked? Again, leaked by who? Are Experian admitting to a leak having taken place from their company? and therefore I am a high risk of fraud, GPS info from my phone on that day (I had made a three hour car journey during the application time). How do you know the exact time the application was made ? What has your physical location at the time of the application got to do with anything?
I am now getting radio silence from them. I have reported it to action fraud but they advised, "The use of another person’s identity, often referred to as identity theft, is not a police recordable crime."
If anyone has any advice on where I can take it from here? I am so shocked that Capital One have behaved in this way, I told them that the addresses were not mine They probably know these 2 addresses are not yours as this was a security question and anyway the application was not made with 2 addresses was it? but they said because the email and dob was that is enough.No it's not shown on any of my files which is even more baffling. I thought there might be a delay before it shows up? Capital One's response was:
"We are writing to you regarding your claim of impersonation. Having completed our investigation, we are unable to accept your claim of fraud.
We have based our decision on information provided by you, credit reference agencies and fraud databases.
Because of this, the record of the search will remain on your credit file but as no account was ever set up and there are no payments due there is no further action required."0 -
Excuse me - why are you being so rude and combative towards me? I came on here looking for some advice and you have just come at me for no reason - this is my first post, I have never had this happen before hence why I was asking for advice - I thought this is what this forum was all about?
I have no idea why a fraudulent person would make an application using my email address. The note from Experian on my file says that, and I quote:
"What have we found?
Your email xxxx and the password you use to access it
Why do I need to know?
They are being sold together online by illegal black market communities. This puts you at high risk of becoming a victim of fraud."
I thought the two may be connected hence the mention. The reason I mentioned the GPS is because when I got the refusal email it was during the time of my three hour car journey so the hope was that my application was submitted during that time. Also as mentioned I didn't know if these applications show up instantly on your file or not, I thought there may be a delay?
Not that I should have even bothered explaining myself to you - but thanks so much for your feedback and "help".0 -

If there is no hard search then your credit file has not been affected in any way by this application.0 -
I didn't know that the search would appear immediately as I had read it could take up to 30 days, obviously I was misinformed. Also when Capital One contacted me and said the search would remain on my file because they didn't believe I hadn't made the application this is why I asked the question on here because I don't want my file to show up a credit card I didn't apply for.
Obviously I am getting the impression that this should have showed up immediately and therefore if it's not showing on my Experian credit report then I have nothing to worry about.0 -
One of my colleagues experienced this before. He clicked on a link that came through SMS saying something about HMRC tax refund, and filled up his details. He said the website looked exactly like the HMRC website he didn't realize until he read a news article about scams, but it was too late. He later reported fraud. I am not sure what happened after that.0

Have you checked your Equifax and TransUnion reports?
Capital One only search on Equifax but report to all 3 CRA's once the account is opened.0 -

There are some really knowledge posters on these boards. Please do not be put off asking for advice. Unfortunately you have to take the rough with the smooth on open forums. Good luck anyway!0 -
Capital One came back to me today:
"Further to our recent conversation I am now able to confirm that someone has been using your personal details to impersonate you."
It's been recorded with CIFA and UK Fraud Prevention Service and any links between Capital One and my credit file will be removed. Obviously that additional info I gave was enough - thanks for advice some of you have given me.0
