I was just thinking that by making out the signs were bad and the lighting was poor, etc. it may work against me, but you're probably right, there's always room for improvement. I'll try to word it as such.
I will also spell out how the PCN is not POFA compliant.
Also, just noticed (in my spam folder, so it's a couple of days old) an email from PE. In it they say they have put my appeal on hold 'whilst we wait for further information'. They go on to say 'You have stated that you were not the driver of the vehicle at the date and time of the breach of the terms and conditions of the car park, but you have not indicated who was.
ParkingEye have placed this charge on hold for 28 days to enable you to provide the evidence requested. If this information is not provided within 28 days, the appeal may well be rejected and a POPLA code provided.' Alternatively, they add, I can make payment, etc.
Bloody cheek!! I didn't say I 'was not the driver', I said in my appeal 'There will be no admissions as to who was driving and no assumptions can be drawn.' Thankfully I've read the posts and stickies on this board that you've pointed me at and I can see what they're trying to do. Makes me feel sick!

And nothing about poor lighting if it was daylight.
More like focusing on the 'sprawling' large multi-ruled car park and the multitude of signs bombarding a stressed Hospital visitor, and maybe that the driver saw no actual PDT machines at all when driving or on foot when walking from the car to the entrance, and you could put P/Eye to strict proof of the positioning of the PDT machines compared to their evidence maps pinpointing where the driver parked that day.
(clue - they won't be able to!!).

I doubt very much that you need to 'make out' that the signs were poor. The PPCs' signage is not user-friendly.
The signs are the basis on which the contract is supposed to be made - yet so many things are wrong with them in terms of clarity and accessibility. Add to that the fact that they are so often located at sites where people are likely to be harassed, excited, sad, fearful etc. etc. and the lack of clarity amounts to entrapment.
Take a good look at the content of the signs & the way they're positioned again and assess them with fresh eyes. If you genuinely start to see the flaws then your signage section is more likely to be a good one.0 -
You only need the out of time appeal point if properly spelt out. That is law - the rest is opinion.0

It's been a while ... I just realised I never heard back from parking eye. I have checked my inbox and my spam folder and have had no emails for nearly 2 months. I have had nothing in the post. Do you think they have forgotten or given up or are they waiting for something from me? Should I leave it and assume it's gone away or should I be proactive and contact them?
