Removal of deceased name from house deeds.

As my father has recently passed away, is it essential that we apply to have his name removed from the house deeds and land registry documents. I'm asking as the house is now up for sale and my mother, who is still alive, is now the sole owner as she inherited dad's half as they were joint owners of the house.

    The solicitor handling the sales will deal with it. He will need the probate and death certificate.

    Since your mother, as joint owner, is still alive the solicitor won't need probate for your father in order to sell the house.

    I had this last year selling late mother's house, no probate for father who died 20 years ago, solicitor dealt with the entry (both names still) on the Land Registry on sight of both death certs and probate.

    No need to remove dad's name.


    Mum sells the property and provides dad's death certificate.


    Is mum doing the conveyancing herself? Sounds like she shouldn't. Is she using a solicitor? Sounds like she should be talking to her solicitor!

    From my experience solicitors are well accustomed to this. When we did the whoops Dad's name is still on the deeds bit, the solicitor just said no problem just bring his death cert in. It was only a very minor complication that the death cert was in Portuguese as he had very inconveniently died on holiday there. Just leave it all to the solicitor. They didn't even charge us an extra penny for this.
