I had no idea this was part of my fathers estate and he passed away 9 years ago.
It has now only come to light as the other two parties wish to re mortgage for a better deal.
Surely it was valued for probate? Was any IHT due paid?
Who was the executor of the will?0 -
Might the other two co-owners be willing to buy you out?
You could then put that money towards a deposit, and might not need to use HTB - allowing you to get a cheaper mortgage rate.0 -
How old are you now? Were you under 18 at the time your dad died? Who are the other parties to you... relatives?How's it going, AKA, Nutwatch? - 12 month spends to date = 3.24% of current retirement "pot" (as at end December 2025)0

Do not let them get a loan against the property
If it is an existing mortgage have they informed the lender of the death. Or just carried on with the mortgage.
All looks very dodgy
Insist on 9 years of accounts.
Even though you are not a legal owner you will be a beneficial one for FTB and tax purposes.0 -
The first thing you need Lewidge is a solicitors advice, as others have said there's something very strange going on, possibly for nefarious reasons, possibly just ignorance, or maybe we dont ahev the whole story. For a property not to be transferred into beneficiaries names where the person died 9 years ago is not "normal" . Have you been receiving any income/benefit from this and what did the will say?? There are all sorts of tax and legal issues here.0

So
* who was/were the Executers/Administrators of your father's Estate?
* was Inheritance tax due and if so was it paid to HMRC?
* was Probate granted?
And why on earth was the Estate not wound up, including transferring the property out of the deceased's name intothe name(s) of the Beneficiaries.
At best, there has been some very sloppy management of the Estate - at worst something very underhand going on.......
And for 9 years you've been denied your rightful share? And denied the rental income you are entitled to?
I would be asking some very probing questions if I were you.......0
