A reasonable person would assume they were on private property and make checks to see the nature of the parking space and if there were restrictions.

A reasonable person would expect signs to be lit at night, T&C to be of reasonable length, at reasonable height, and in reasonably sized print.

Very few are, please read this and moderate your ill-informed diatribes.

When you take your car out and turn off the highway, where do you think you are when you leave it parked? A reasonable person would assume they were on private property and make checks to see the nature of the parking space and if there were restrictions.

This false blindness is wearing thin in some courts as there is a high expectation of drivers in terms of their ability to read road signs. You are asking a judge to agree the need to be aware of the surroundings disappears when leaving the highway - or you expect to be forgiven when dumping your car on someone else's land.

You may be lucky with a forgiving judge but don't expect it.
    Did the BPA send you?

    Or the IPC?

Or a member of one or t'other?

And (apart from an odd awful court like Swansea, who are clueless about PPC scams) which courts are you aware of, where patience is wearing thin with Defendants stating, quite rightly, (as did Parliament on 2.2.18 during the Parking Bill debate) that private parking signage is - for want of a better expression - utter pants?

And why do we bother you so much that you have joined MSE without registering officially for your company?

Wouldn't it be better to register openly if you feel that your company is right?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Members, quick update. Have submitted defence and have received acknowledgement from the county courts.

A quick question: does it make sense to send an Email to enforcement@parkingeye attaching the pictures of the car park that clearly show that there is not lighting nor are any of their signs lit and visible. This will hopefully show them that they don't have a case and perhaps pull out saving us all the trouble?

    Thanks

    Eh, no not really.

They won't/don't care so don't waste your time.

Plus you may implicate who was driving so best not.

If any more experienced member suggest you do then take no notice of me:)

    That question assumes that:

    a) they actually read anything you send them
    b) they are sensible and reasonable
    c) they aren't just interested in scamming you in any way possible

    None of the above apply.
