    FWIW, I don't think most posters were saying that you had no potential claim, just that on the face of it...it sounds like it may not be worth a claim.

    You probably did have a contract - if a contract is binding on you then its binding on them. But the issue (as I said to waamo previously) is that it sounds like you could source a comparable car for the same price - meaning your losses from their breach would be negligible as you are expected to mitigate your losses - the same as the dealer would be expected to mitigate theirs (by finding another buyer for example) if you had been the one to breach the contract. You're supposed to take reasonable steps to mitigate and not take unreasonable steps to increase your losses (or at least, damages will be awarded on that basis regardless of the action you took).

    You do have rights - you have the right to get your deposit back and the right to feel miffed about it.

    I agreed to buy a cat (and paid a deposit) but was only collecting it after the owners ensured it had all its immunisations and was dewormed.


    According to the seller the cat apparently had an allergic reaction to its jabs and died.


    The seller then refused to sell me the cats corpse and wanted to refund me my deposit.


    I was (understandably) furious and sent them a LBA.


    After a protracted period of time during which I camped outside their house (loads of placards and shouting.... they didn't like that up em) they finally saw sense and agreed to sell me the cat as per our previously agreed (legally binding) verbal contract.


    Deal was finally completed & I even managed to get them to deduct the cost of the spade I used to retrieve my purchase (that was a bonus because I got to keep the spade).


    Don't let them win, you have right on your side.


    You sometimes have to fight to get what you are owed - now Tiddles (I affectionately call her "Smelly Cat") and I couldn't be happier :-)
    Was it really "everybody" that was Kung Fu fighting ???
