Intestate process questions:-

Hello all,

When applying to become the "Administrator" of a deceased persons estate where no will can be found is only one person that can take this role or may it be two possibly three? We know from discussion who was asked to be executor of the will- that hasn't emerged yet and is thankfully taking the lead in trying to organise things.

Is the process straight forward? Do we need to use a solicitor- house with mortgage, some debts/ credit agreements but these have already been informed, funeral arrangements made, do we need someone legally appointed as administrator before proceeding any further?

Assets likely to be under IHT threshold, house equity, life insurance and car worth around 9k. Pensions I know sit outside of the estate and they are looking to see who they have been nominated to benefit. No vast sums of money or shares to sort.

The person had no children/ spouse etc, so a single adult, so it would appear that sole surviving parent will inherit any residual monies- not an issue of anyone squabbling over monies (I think!-famous last words).

    The beneficiary is the one that is first in the order of those that should apply to administer the estate.

    There is no need to involve a solicitor in the probate/estate administration its quite straightforward.
    Most of the probate forms you will need are here:
    https://www.gov.uk/government/collections/inheritance-tax-forms
    Since there was no will you need form PA1A which is here:
    https://www.gov.uk/government/publications/form-pa1a-apply-for-probate-deceased-did-not-leave-a-will
    Its easier to complete the .pdf forms on your computer rather than print a blank form because you can save a partially completed form and also any totals and b/f & c/f figures are automatically populated for you.

    Start by reading the stickies at te beginning of This forum. They will tell you the basics. Lots to learn but you should be able toDIY it. First thing is to tell the bank so her account i frozen.

    Thank you for the tip, interesting reading. On the brighter side of things the events of the last week have prompted Mrs CRV and I to look again at our specific wishes, appointment made to see the Solicitor next week, planning on setting up POA for health and finances at the same time- just in case!

    A solicitor will charge a fortune to do the POAs. You should do it online.. Quick and easy.
