Elite Management Midlands ltd Parking Charge Notice

Hi everyone

Thanks for all help so far. I’m starting this as my own thread after unwittingly hijacking someone else’s. Apologies.

I’m a teacher and parked with land owners permission in a car park neighbouring the school. Pass not displayed (laminated card made by the school) on the day and a Parking Charge Notice Was issued by the above company.

On further inspection EMM LITD have had benefits removed by BPA so I would have been fine had I not given them my details. However, not knowing anything about how to handle these things at the time - I daftly did, pleading my case - here’s a photo of my pass and proof of having worked at the school today I said.

This was not good enough. They said I had no authority to be parked. £60 to rise to £100 as charge.

I spoke to the BPA and they have said that despite having benefits removed this company still have the right to offer POPLA. I am going the landowner route to see if they can overturn it but fear I might have to prepare a POPLA case.
I would very much appreciate help and guidance with this.

I’m also quite concerned that they could take me to court as I have no intention of parting with money for parking where I was authorised by my employer to park.

    mmmm , for my benefit and others , answer the following question please

    WHY are you concerned about going to court ?


    it will be your local court and a judge will decide if there is any legs in their case and who should pay, therefore what is concerning about going to court ? (we get people saying this all the time and yet nobody can tell us if this innate fear of court is like fear of spiders and snakes ? is it based on something tangible ? )

    I just dont get it at all ? it does not make any sense to me

    if you lose , you pay up , IN FULL , within one month , typically £180 to £200


    they dont put you in prison , they dont kill your cat , they dont kidnap your children either

    so as a valued member of our society with a good IQ (because you are a teacher and therefore educated) - what is it about court you fear ?

    Another teacher pointed out there is no way they can take a day off for a court hearing during term time, so that would be an issue for you I expect.

    So if the school gave you laminated permits, surely the Head teacher knows who took in this scummy firm and will cancel it for you? Someone can.

    As a Plan B, your POPLA code is valid for 32 days max.

    Can you get some photos of the scumbags' signage asap and show us links (broken links, as a newbie - change http to hxxp using Dropbox as your photo host)?

    With regard to plan B.
    I’ve tried posting a DP link but still disallowed even changing Http.

    Just to clarify did you get a POPLA code? This company is banned by the DVLA and an investigation is currently ongoing into their behaviour.

    They might be a bit twitchy at having to provide evidence to POPLA at the moment as it may become a criminal investigation apparently.

    Almost half of all POPLA appeals are not contested by EMM. It suggests that when they see a decent appeal (likely to be one that is lengthy and covers the points in the NEWBIES FAQ sticky, post #3) they will withdraw.

    I think they will have more things to be thinking about than having to put in a huge amount of effort to win a POPLA appeal in order squeeze out perhaps one of the last few £100s they are ever likely to get again in this world (if what waamo says is correct).

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    a POPLa code would only be provided if the company were active with the BPA at the time of the incident

    of your ticket was issued after there suspension date then no popla , just a rogue trader

    No, this has already been checked by the OP and as it's a temporary suspension Elite do have access to POPLA.

    I agree they won't bother to contest. They are currently in the hottest of hot water over a report of an alleged crime (allegedly having knowledge of a 'towing away' and refusing to release a car until money was paid) on land they manage...the popcorn is out...

    I’m still half expecting something from EMM further down the line. We’ll see.

    Keep hold of that landowner cancellation. It kills it dead if they do try it on.
