Another Indigo/Saba/ZZPS... With a twist...

Hi all,

Afraid it's another Indigo type thread.... I've read the Newbies guide along with many, many other threads but there is a slight amount of conflicting information (unless I'm reading it wrong) which would be great to get some clarity on.

This is in relation to parking at a Railway Car Park with Byelaw 14 being breached.

The Newbies thread points to the excellent guide by stationcarpark2008, which I've read many times, who appeals with the standard BPA template and requesting a POPLA number with the appeal being rejected. However many threads since then say to not appeal as POPLA are no longer dealing with appeals and to ignore? Although it looks like they are on the POPLA website?

Which path do I need to proceed down?

Received a letter from ZZPS on day X (keeping dates a bit blank as we know these people read these forums!) for a debt collection of £170 due to unpaid debt. The usual one I'm sure we're aware of.... However, no PCN or NTK had been received...

Then a few days later a "Notice To Owner" arrives with an amount payable of £100. I have had no Notice To KEEPER, just a Notice To OWNER.

So just to clarify, the NTO is dated AFTER (by a few days) the ZZPS letter. How can they issue a debt collectors notice when there's no notice been received?! Surely that's grounds for instant dismissal or unfair manipulation?

Should I send the standard BPA appeal to Saba asking for a POPLA code or just let it be?

One final thing, the ZZPS letters are going to our old address (we moved at some stage and updated all our log books, driving licence etc.) however this all started before we moved. Those now in the house are getting quite concerned about the situation, due to the use of address and worrying it may affect them. Would they be best off putting the letters back in the postbox with "no longer at this address" on them?

Of course since this all started, Indigo have now become "Saba" to add another layer of excitement!

I read a post somewhere saying that the advice was now just to ignore everything and that the Newbies guide would be updated over Easter, but it doesn't seem like the Newbies guide has been updated, hence the checking.

    The latest thinking is to ignore it. POPLA is indeed no longer available so silence is golden.

    Is best course of action for new owners to simply pop the letters back in a postbox with "No Longer At This Address" on? Assume that in doing so they have nothing to worry about?

    Ludicrous idea, why on earth do posters sometimes suggest this?!

    Sorry for the ignoricane Coupon-mad, but not sure which bit you're referring to? Presumably the post bit in which case could you advise why it's such a bad idea? (Again pardon the ignorance!)

    Furthermore I notice your sig now says NOT to ignore a "Private PCN" - presumably the Indigo/Saba ones are an exception to this? Or is there a new course of action to take with those?

    An Indigo one is not a private PCN. Read other SABA Indigo threads, it saves us typing. It's dressed up as a penalty, hence why you can ignore it.

    Interestingly it seems the initial penalty was with Indigo who now no longer exist as they're Saba. So surely now it's even less enforceable than before as the company no longer exist!

    However I see a bit of fun ping pong now seems to be the preferred tactic:

    - What Byelaws specifically have been broken?
    - Is this a Civil or Criminal offence?
    - Who is liable? Driver, Keeper or Owner?
    - Please send me copies of your authority to operate at the land in question?
    - Can I make an offer of payment?
    - Do you offer credit facilities?
    - Please supply full copies of all photographic evidence of the alleged offence.
    - Where can I find more information about Railway Byelaws?
    - What if I can prove I wasn't the legal owner at the time of the alleged offence?
    - Has there ever been a BPA inspection and if so when was this conducted?
    - I read on the POPLA website that since December POPLA was able to adjudicate on Railway Byelaw cases, is this correct?
    - Why haven't I been sent a POPLA code?

    As posted in another thread. I quite fancy something to keep me occupied....

    Should this ping pong be with ZZPS/QDR or Saba?

    Similarly at the 6 month mark should the GDPR data delete request be sent to ZZPS/QDR or Saba or all 3?

    Finally I see from another thread that they then start threatening CC action. All our letters definitely mention Byelaws and not a contract breach. If such letter is received, what's the process then?

    And before that they were Vinci Park. Aggressive, anti-consumer horrible firm no matter what name they use. I'd be ashamed if I worked there.

    Complain and insist they all erase your data. Report them to the ICO if they refuse.
