Hello. I'm looking for help for a friend in a similar situation, 18 mths old. Rogue trader ripped her bathroom out and left her with no washing/bathing facilities. Trading standards and council got involved. There was environmental/health and safety risks so council completed work, my friend now owes the council for that work, she thinks?
CCJ has been issued for £12,000. Respondent has ignored all paperwork.
Friend has been advised there are 4 options and been directed to EX321 on gov.uk site. The pertinent part are the considerations atm. -
Before you decide how to continue you should consider whether:
• you are likely to get your money and court fee from the defendant;
• the defendant owes other people money or has other court judgments;
• the defendant owns any goods or assets which can be taken and sold at auction;
• the defendant is working;
• the defendant has other earnings, such as income from investments;
• the defendant has a bank, building society or other account;
• the defendant owns property (a house); or
• anyone else owes the defendant money
I would say the answer to all these is NO. Respondent is self-employed. No property or assets as far as we know. What is the best course of action? Also very importantly where does my friend stand with the council. The work was ordered by them, not asked to be completed by her but she says she signed something?? She is disabled and mentally/emotionally unstable. I need to find some sort of advocate/help for her. Appreciate any advice. Thank you in advance.
