Check out fees before moving in?

Hi, we are about to rent somewhere, but they are charging us a checkout fee together with referencing fees, and it states this is non refundable if we dont pass credit checks.
How can they legally charge a check out fee, if we possibly never move in ? thanks

I wonder if this is due to the imminent change in legislation around agency fees? If they charge them all up front, before the new guidelines come into play on the 1st of June, they can still benefit.
Very cheeky, but completely expected from some estate agents...0 -
But can they really refuse to refund check out fees if we never actually check in ?0
