Hello All, this is my first post on the forum so thank you in advance and sorry for the essay please bear with.

The issue i have and what i need advice on is amongst several other things a discharged CCJ that is causing havoc on my credit file.

Firstly a bit of history .... I split up with an ex a few years ago and rather than do the intelligent thing of sorting all finances out and ensuring i advised people of forwarding adresses etc i instead decided to bury my head in the sand and move on with my life.

Which brings us to today, i have never really worried or looked into my credit file however i receive a letter from Halifax (who i bank with) at my most recent address saying that the amount owed on a credit that was passed on to another company (Intrim UK finance) was incorrect therefore they have taken this debt back and will advise further shortly.

How strange i thought as i don't remember owing Halifax money but i looked into it and it appears to be from an overdraft i had some 5 to 7 years ago with my ex.

Next stop i look at my credit file for the first time and on there low and behold i see a CCJ from intrum UK finance from April 2018 for £3,037 with a status of discharged undefined.

No knowledge of this at all didn't even realise it had gone to court, there were also a couple of pay day loans(£600 in total) which i know are not mine and United Utilities are on there for £1,098. The small debts i will just settle as the united utilities was half me at least although all in my name and the pay day loans aren't massive so considering i am going through a divorce much easier on my life if i settle them.

So to cut a long story short i earn quite a good salary at £50,000 a year and always rented a house never really had debt or credit or needed it. however i have started thinking about a mortgage so need a 3 year plan to fix the credit file and save as much as i can and fingers crossed i'll be in a 4 bed detached in rural Cheshire before you know it.

What i need advice on is where the hell do i start ... how do i get the CCJ removed if Halifax are saying it was an incorrect amount and also the fact i didn't ever receive court papers as i moved out nearly three years ago and the ex moved out 6 months after me.

How do i build my credit score as it's evident i can not get a mars bar on credit!!

Please help me i want rid of that CCJ and i'll settle the rest !!!

***** Worth adding the Halifax Debt or intrum finance debt are not actually on my credit file on Experian or Equifax *****

  • You need to make contact with the issuing court and with whomever issued the CCJ - be it Halifax or Intrum.

Also ignore your credit score as it's not a thing used in lending - only your credit history matters.

If you didn't take the payday loans out, however small they are, you should report these to ActionFraud

    Hi,

Once a county court judgement is registered against you, you have 30 days in which to pay it in full, then it will be removed from your credit file.

As you were unable to do that, your only other option is to apply to the court for a set aside motion.

Now in order for this to be successful, you need to have a defense, with a reasonable chance of success, the fact you did not receive court papers can be concidered to be a valid reason for a set aside application.
To apply to get the judgment set aside, fill in the application notice (court form N244) and send it to the court. You may have to pay a court fee of £255.

You have to go through this process, as just paying a CCJ over 30 days old, will not remove it from your credit file.
