Hit by uninsured driver! Help!

  • Next time just call 999 right away. Driving away from an accident is a crime, let alone not having insurance. The police may have had a car in the area to chase him down, and would probably be interested in witness statements too.

The advice you have been given is basically correct. If you can wait try MIB.

I suspect not, but it’s more the principle of the matter. He deserves to face some kind of justice...

Maybe so but that does not fall within your remit. The Police and court system will take care of that.

I hope you get this sorted, he should be banned for driving for 10 years.

I 'm firmly of the opinion that anybody caught drink or drug driving, driving without insurance and/or without a licence should lose their car, either sold to reimburse their victim or if of little monetary value, then crushed.

Thanks all for your replies - it was such a ludicrous thing to have happen completely out of the blue, and now the system (at least for reimbursement for damages) really seems rigged in favour of the criminal. I suspect you are right, it will a long, drawn out affair with a lot of time and money at stake. Time and money that I don’t really have sadly.

Why will it cost you money if you wait and claim off MIB.
You said your car was driveable.
Does it need to be in showroom condition imminently?

Hi Lissyloo - no it doesn’t need to be in showroom condition imminently. I will go the MiB route and hopefully avoid having to make a claim for the repairs with my insurance company.

[DELETED USER] - I did call the police immediately. 101 as it wasn’t a life threatening emergency, was on hold for 16 minutes.... by then he was long gone.

If you have comprehensive insurance of your own you cannot claim from the MIB as an alternative to claiming on your own policy (Linky, page 5) The MIB is basically an insurer of last resort - it's main purpose is to ensure that victims of uninsured drivers aren't left destitute if they're seriously injured and unable to work, not to ensure that they keep their no claims bonus. Hence it will only pay for losses that are not covered by any other insurance policy, including your own.

That link and advice in #17 is years out of date!

OP, consider Google for accident management companies who will pursue the mib over a claim against an uninsured driver

It's the advice currently given on the MIB website! (See the link on here - Guide to making a MIB claim)

The MIB agreement was updated in 2015 to avoid the MIB being liable where the victim has other available sources of recovery (Clause 6, page 5). This appears to have been unchanged by the 2017 update to the agreement. So what do you think has changed since 2017?
