Recieved Lloyds TSB solicitors letter.What to do now?......

  • Are the solicitors sechiari, Clark & Mitchell? If so they are based in Lloyds-TSB collections center in Brighton.
    I am on a self-managed DMP and have an arrangement with Lloyds-TSB who for 10 months have not credited payments made to my loans (they sit in my account clear for all to see!) I received a solicitors letter threatening legal action as well - I respoded by registered post, which they signed for and then denied receiving. I wrote again and also faxed a copy via my pc basically saying take me to court as I have an arrangement, I'm paying etc - I heard nothing for Sechiara & co but Lloyds sent a letter extending my dmp arrangement!
    LLoyds are rubbish at administration and communicating and I think this extends to telling their solicitors the whole pictiure though they are the same bunch who never turned up for bank charge (reclaiming) hearings............
    You could write to them (registered post) and fax a copy via your pc - point out you are paying as per your dmp budget and no one creditor is being favoured and that if legal action is taken you will obviously bring this to the courts attention. If you do receive court papers fill in the defence.

    ME and hubby have cc/loan/overdraft etc.......with lloyds,and we have had the same letter as you. We were told by payplan,to wait and see what will happen next,we also sent letters etc...they haven't replyed either,good luck let us know how you get on.

    We had a letter from the solicitors was it on grey paper? From the company mentioned above.

    Once I got my letter I wrote a formal letter of complaint at the charges levelled against me, I listed all the letters I had written and payments I had sent. You could also mention the threatening tone of the phone calls and how you FEEL it is harrassement. Give it a go, I never heard from the solicitors again and they accepted a payment for the year and fronze interest and sent a case of wine out too! Copy Lloyds and the solcitors with the letter.

    Read this link if you get chance and see if Lloyds have broken any of the points mentioned.

    Oh don't forget you must put at top of letter "FORMAL COMPLAINT" you will know if it has been treated as such because when they respond they should send you a leaflet about complaints procedures and don't forget recorded delivery!
  • hi, i have lloyds as my o/draft. i started my dmp in april! and after loadsa complaints through c.a.b lloyds's finally accepted my d.m.p.

    they upped my o/d limit to 6'230 and SAY they have frozen interest from 1st novemeber but have yet to see this. i am currently paying £74.00 a month and getting charged £90 a month interest!

    its tricky for me. i cancelled my name off the joint account (which is in credit) and i also have my mortgage with them (was originally cheltnam and gloucter but now lloyds aparantly)

    had loadsa arguments on the phone to them. i will tell you if they have stopped interest around begining on dec when charges are due.

    Can I also point out that Lloyds TSB have to legally serve certain notices ie "final demand for full payment" before they can "take" legal action.

    In my experience - once these notices have been served - they are more likely to accept the offer of repayment being made via Payplan.
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!

    Take the credit yourself you composed the letter and spent the time collating evidence! I am really pleased that it worked out for you so many times I tell people to make formal complaint but by then you are just hacked off so well done!
