It's understandable confusion because DWP have called both benefits ESA. The issue is that 'legacy' ESA was a hybrid benefit that contained both a contribution based and an income based part so claimant could indeed get income based award added to a contribution based claim. (DWP failed to understand this themselves when messing up the Incapacity Benefit to ESA transfers which is now costing £40 million in administrative costs to correct). New style ESA is solely contribution based and UC has taken over the income based component.Information I post is for England unless otherwise stated. Aaah I see so they can apply for UC right now (or at anytime) even though they are on SSP as they could get a little extra in regards to other benefits?
If they did this and they got £60/month would the UC then be added to once the SSP finishes if we advise they can no longer work and would have at that point applied for ESA?
Yes UC would go up when SSP ends.
Standard allowance is £317.82/month.
SSP is £94.25/week which is £408.42/month so an earnings deduction of £257.30 is made
This leaves £60.52 payable/month.
When SSP ends the entitlement is £317.82/month.
If he has a Work Capability Assessment and is found to have Limited Capability for Work and Work Related Activity an extra £336.20/month is payable from the fourth month.
Any ESA claimed and awarded will be paid separately but deducted from the UC so overall income is the same. He doesn't have to claim ESA.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
At the moment their income is £408.42/month SSP plus £150/month Tax Credits. Total = £558.42/month.
SSP ends
Claim UC (and ESA if they choose) - £317.82/month
If found to have LCWRA from fourth month UC rises to £654.02/month, otherwise it remains at £654.02.
