section 75 - would i be covered for flights ?

Booked Holiday Flights in July 2018 for May 2019 on a self organised fly drive trip . 1 week ago other half received letter from Hospital for a significant health issue that needs further investigation and now on waiting list which is currently looking at July . Cannot now get health insurance for the overseas trip as pending medical investigations and the flights are non refundable. Return Flights booked through Expedia (£1300 approx) and on Credit Card..... Do you think i could claim under section 75? many thanks.

    No. You should have taken out a travel insurance policy.

  • Sorry to hear about the health concerns - that must be a worry. S75 only kicks in when the supplier of goods/services is in breach of contract.

    Are you sure you can't get insurance cover for the trip - assuming you would still want to take it? My understanding is that you could still get cover but the particular health issue would just be excluded. If what I believe is correct and, if the health issue is not something that's likely to become an acute issue in its own right or cause any knock-on conditions, you might still be able to take the trip.

    For future reference, always book travel insurance at the time you book the trip and never forget to declare all pre-existing conditions/diagnoses - e.g. if you have ever been diagnosed with high cholesterol/blood pressure etc. People often overlook that sort of thing.

    You won't be able to claim section 75.

    Check with the airline as you might be able to pay to change the date/time of the flight even though the flight is non refundable or at least get a refund of taxes. I've looked into this recently with BA for a flight for a family member and they allow a change for £150 or can get a refund of taxes for around the same cost.
