Quick Update: Had a hearing today, District Judge did most of the argument on behalf of me and my witness while cross examination
Finally judge dismissed the claim with 2 reasons and awarded 150£ towards the costs for me and my witness and asked claimant to pay with in 21 days.
1). The contract between UKPCM and Property management is questionable. Even if proven signs are not visible to the user and there was no evidence provided to prove otherwise.
2). Tenancy agreements provided right to park for tenants and their visitors and tenants were not aware of any such restrictions imposed on them.
Even though judge said Counter Claim is well written, she believed UKPCM contract with property management was reasonable reason to access the data, even though Claimant's actions are questionable, after notifying the legitimacy of the defendant parking rights.
I will post the judgement order, once I receive it.
