Need to cancel part of order

Hello,
Just after a bit of advice please.
I went into a well known sofa shop and agreed to take finance agreement out through them (Ikano) for a sofa and carpets.
A while has passed and I am still waiting delivery for said items. Long story short I have had a change in circumstances and need to cancel one of the carpets. When I tried to do this through the store I was told that I wasn't allowed. I really don't want to be stuck paying for a carpet that I don't need. Bearing in mind we haven't agreed a delivery date is there any way I could cancel the finance or just not arrange a delivery date for said carpet? Can they still take a payment for the finance of a product has not been delivered/fitted?

    What does your contract say about part cancellation of an order? I doubt that stalling on a delivery date will release you from your obligation.
  • There's no mention of part cancellation. I think it's awful that they don't take into account if someone has a change in circumstances. It was never brought to my attention when signing the contract and to be frank it all felt very rushed and I certainly wasn't given the opportunity to read the terms in the back of the page. From the moment we went in there we were followed around the store getting the sales pitch. Yet when something goes wrong they don't want to help. All very frustrating .

    Maybe the fact that it is a CONTRACT is the important bit here. Both asides agree to a set of conditions for the transaction and must meet them. If part cancellation isn't in the contract then your only hope is goodwill, and it looks like they are not prepared to agree to that.

    If part cancellation isn't allowed can you cancel the whole order then re-order the items that you do want? Obviously that'll probably further increase the time until you get them, and the prices may have changed since you first ordered, but it could still be cheaper than ending up with a carpet you don't need.

    You mention that part cancellation isn't in the contract, is full cancellation? If so , and assuming the cancellation is free of any cost to yourself then cancel the lot as at that point they might be prepared to reinstate the part you want rather than lose the lot.

    However with things like carpets and sofas bought in store there is rarely a free of cost cancellation option so you would need to read your contract carefully.

    As for cancelling finance, that merely cancels payment and you would need to find another way to pay.

    Next time, walk away if you feel pressured and rushed. It’s no good complaining about the terms of sale you willingly signed without understanding. I’m sure if things were reversed and they cancelled one part of your order you wouldn’t be happy. The contract works both ways.

    As others have suggested, see what your options for full cancellation are. Even if there’s a small charge to do so, the threat of you cancelling might persuade the retailer to reconsider the situation. I’m sure they’d rather keep the bulk of the order.
