PCN parking on private land - double yellows - inadequate signage

Hi all
I’ve had a read through everything but nothing seems to relate to this case.
The driver recently parked my car on the service road before entering Sainsbury’s car park operated by horizon parking.
It’s a well known free parking spot and traffic wardens have told the double yellows are non enforceable due to not being on council land .
There are daily 10-15 cars parked on the road
There is one sign that only indicates you are entering an ampr car park and a three hr stay is maximum. The camera is another 200m around the corner at the actual car park entrance. The sign Says In smaller feinter writing ‘see signs in cRpark for other terms for parking on private land ’ but on first look You only saw the time restriction as this is what’s in huge letters. The car parked adjacent to this sign (And did not pass it by more than a wheels breadth if that!)
There is no mention of any other specific terms or of any fine relating to them on the sign.

Driver came back to find after a 2 hr stay mine was the ONLY car ticketed for ‘parking not wholly in a bay’ - other cars were parked there 7/8 hrs by this point!
Driver didn’t even think They were in the car park as hadn’t passed the camera, no signs said this was a restriction, and the first sign detailing that is 200m further down the road and in the car park itself!
The car was the only one parked obscures from view of our office so clearly got the only ticket as the warden hid from view to issue it and could not do so with other cars.

To make things worse 12days after the ticket they have now installed clear huge official horizon parking signs saying no parking in that area and explaining the terms and fine.

My argument is this:

1)The car wasn’t in the car park, It was on a private road where is wasn’t clear there was any fines enforceable.
The sign that you are entering a camera controlled car park and that terms are found on signs in the car park.... thus implying The car haven’t entered it yet and the camera entrance is 200m further along a road!

2)The signs are unclear!
The sign makes no reference to any fine and only clearly displays 3 hr time limit which did not breach.
The ‘not wholly in a bay’ is not relevant as Car wasn’t in the car lark yet!
The Fact that they installed three clear official no parking signs 12 days later indicates the signage wasn’t adequate at the time The car got a ticket!!

3)No other cars in that area at the same time were ticketed making it unfair and targeted

Ps hav spoke to Sainsbury’s who said does seem unfair but not their problem!!

  • Not really any different from any other case - just follow the standard process as per the NEWBIES sticky (at least at this stage).

    What happened AFTER the parking event is not really relevant.

    Host pictures on something like photobucket or tinypic. Then post the link here, but change http to hxxp or something to break the link. Someone here will then fix it.

    I’m sorry I don’t understand what you mean about what happened after the evebt?
    The signs on the wall only went up 2 days ago, Car got the ticket 12 dats ago!

    Complain to your MP, they are very much aware of this scam and on 15th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    Because you've used your first name to identify your photos. PPCs haunt these fora just waiting for someone to slip up and identify themselves so they can use your posts against you.

    The signs being there now are not relevant. What is relevant is what signs were present for the driver to see at the time of the alleged event. Sometimes these can be found on googlemaps or similar, but only if the photo-car entered the site or they can be seen from a public road.

    Those are the types of images you need.

    Do you know anyone with a dashcam who has visited the site before the new signs went up and still has the footage?

    If you can't get them, then witness statements that no signs were present would help. One from the store manger would be useful.

    You need to edit the disguised link out of your post.

    Also delete the page at your hosting site (which can be found via cache after editing your post)

    The ppcs monitor this forum and can use posts in your thread against you
