    I would start again with the manufacturer/retailer. They are the ones who will sort this out but you have been making it very difficult for them, probably because you have had some very very bad advice. Tell them that the LBA and refusing to send the cable back was a mistake and that you did it because you received some bad advice. Then perhaps you will get some cooperation from them.

    The insurance point is a complete red herring - whether or not you have insurance has got nothing to do with your legal rights against the retailer, and even if you had insurance it's hardly a big enough loss to justify a claim (or may even be less than the policy excess).

    OP says it was a Game branded charger, so OP may not know who is the manufacturer. OP is already dealing with the retailer. :)

    Thanka again for the replies everyone.. yeah I'd I'd think any excess would be more than the repair they're going to get back to me (apparently) as to whether their final say is that I have to claim it on my own insurance for them to accept that it is damaged- I think at that point I would need further advice.

    I am handing the item back to the retailer, it is own brand so no idea who the manufacturer is, and I have sent an email saying I think I was being hasty due to bad advice and that I have not ruled out court action but i am willing to accept that it may take longer than 28days to test it, and please can I have a rough timescale.

    Regarding my insurance problems I have tried so many times to get insurance - when I call to check what their policy is they all just state " cancelled for whatever reason". My coworker took out a policy at 18 just to get meerkat movies then cancelled it, and had a new policy which they subsequently claimed on a few years later, with no problems. But my worst nightmare is paying for a policy then when I go to claim they say I lied on my application. My partner also can't seem to get insurance as it says you or anyone you live with. It just seems so harsh. I might try writing to one of the companies and explaining what happened and see what they can do. I am willing to pay more for the insurance. I think this is what is causing me so much anxiety regarding windows, fire etc, as we live in a rough-ish area where there are a lot of burglaries and I am constantly checking windows, doors etc. Having insurance would help a lot. I think Homeprotect agreed to insure me but their small print said that I had to have a professionally serviced alarm which I had questions about. They were very hard to speak to and when I emailed they just never responded. Facebolk reviews said they dont even pick up the phone or reply about claims so I was a bit apprehensive about giving them any money.

    They cannot require you to claim on your insurance. Your insurance only came up because you would not give them the item, so they were saying the only way in that case to deal with it would be through your insurance company.

    There is no need in this case (at the moment) to involve either insurance or court, even if you DID have insurance.

    Completely agree and that makes sense now. Like I said I'm sending them to the item to test it and will see how it goes from there. Just completely starting again with the whole thing. Thanks:)

    Your co worker can get insurance because HE cancelled the insurance.

    You have a problem because the insurance company cancelled your insurance.
