Should I wait for this buyer?

Sold a mobile phone at the weekend, it was won by someone with decent enough feedback.

I got an email from the buyer saying that their account had been hijacked, and that although they'd actually bid on the phone, there were a large number of other items they'd not bid on, they'd just only noticed.

Seems they've responded to a spoof email and gave out their EBay and Paypal details! :o

They asked if they could pay by cheque as they don't want to risk using their Paypal account. I don't accept cheques anymore as I've had several bounce in the past.

Although I'm sympathetic toward the buyer, I don't want to risk taking a possibly iffy cheque for the phone (worth £100). So I've told them no - I only accept Paypal (as specified in my auction). I've not had a response back and not sure if I will get one.

I sent a second chance offer to another buyer and they want to buy the phone, trouble is, they want it pretty quickly and have said they will go elsewhere if I don't sell it to them by tonight.

I don't know what to do now - should I wait for the first buyer or sell to the second one?

Why not ask your buyer to pay by uncrossed postal orders instead. This would totally solve your dilemma. The buyer doesn't have to wait for clearance of the cheque and you don't have to worry about the cheque bouncing :)

Also, you could also check your buyer's history to see if what he says is true.

    Good luck ;)

If you sent an official second chance offer which has been accepted then you have actually sold the phone twice. If this is the case then you must decide which buyer to sell the phone to bearing in mind that both can leave you feedback.

    Thanks for the advice everyone!

I decided I wasn't going to wait for the first buyer, they haven't responded to my emails for 3 days.

So I dropped them another email last night saying that I'd sold the phone on and no longer had it.

Filed a non-paying bidder report saying that we'd mutually agreed not to proceed with the transaction.

Guess what? An immediate reply - they've agreed with the NPB and I've been given a final value fee credit. They've also left me glowing feedback!

I was a bit surprised but it all seems to have worked out great!

You cannot start the NPB process until day 7 so the fact the system let you, and immediately went to the final bit of the process can only mean that the buyer is still NARU'd.
