Hi all, does anyone have any answers to my three questions above?
1) When we send the email with RK details to the "correct" email address do we need to set a "reply within x days" timescale?
2) Does the named RK need to do anything? Last communication they had was saying that they needed to be authorised.
3) How long should I wait before contacting Steve Clark at the BPA? Is there a timescale that I need to give them after I've sent the RK details to the "correct" email address?
TIA.0 -
1. You can set a ‘reply by’ date (7 - 14 days might be reasonable), but don’t necessarily expect them to comply. You’re not dealing with honourable businesses in the private parking sector.
2. Wont this depend on 1?
3. Write to the BPA when you’ve hit a brick wall that you are no longer prepared to bang your head against. There are no timescales for such, depends when your head starts to hurt! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

@Umkomaas - Thank you for your reply and insight. Will get that email sent across ASAP.
In regard to question 2, they said they couldn't engage because they (RK named in our email to them) wasn't authorised at the time.
I guess the RK we named just awaits further comms from them...0 -
The named RK has not received anything further after receiving that email which stated that the company named had to give them permission to discuss the matter with the RK.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No the RK we named has not done.
so I gather I should:
1) Forward the sent email with keeper info to the named RK
2) Get the named RK to forward this correspondence in reply to the email received saying that they were not authorsied
3) Ask them for the PCN and a POPLA code
Thanks0 -
Yes.
If the appellant was told ''you need to show you have authority'' then the appellant needs to do this and you can then all move forward and they can come here to see how to deal with it later on.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
Just wanted to update you all on what happened.
We (the company) received an email confirming that the PCN had been transferred to the named hirer.
The email read:
Good morning,
Thank you for your email.
"I can confirm liability has now been updated into the name of the vehicle hirer and you should expect no further correspondence pursuing the Notice."
They also replied to the named RK a few days afterwards (same author as the email sent to the company).
The email read:
"Good morning,
Thank you for your email.
The car park operator holds a contract with the landowner, we do not hold details of this contract and will not be requesting this as it would contain business-sensitive information.
You should expect to receive a full appeal response within 5 working days."
A few days later they rejected the appeal from the named RK and reissued the parking charge in their name with a POPLA code.
Sadly, the named RK doesn't wish to go through POPLA (despite our offer to help them) and would just rather pay the £60 to spare the hassle.

Thank you to everyone who offered advice in this thread, I know it must get tiresome sometimes seeing the same stories time and time again and the winning makes it worthwhile. Unfortunately, the cowboys won this time around.
Thanks again.0 -
Many thanks for the update and kudos to you, for your hard work in trying to stop the lessee/hirer paying a scam!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

twhitehousescat wrote: »ok , the company number and address of ALL PARKING , not the debt collectors
Not trying to hijack the thread, but looking for an advise regarding the company information.
Out of the info provided, the company has been identified as ALL PARKING, and not ZZPS, though address and VAT does correspond to the latter one, and not ALL PARKING, which is registered in Manchester. Was wondering if that is correct?
For those who have same letters - would the advise still be to ignore those and per multiple threads regarding debt collectors (my assumption is still that the letter is on behalf of them, not ALL PARKING?), or to advance with appeals as per NEWBIES thread?
Looking forwards to your advise!0
