The layout, maintenance, desired usage etc are all rovided by the landowner. In other words, painting the ground disabed signs on the bays for disabled, making these spaces larger than normal and choosing where these are falls to the landowner.

The PPC has no responsibility for this. They may advise on matters, but can successfully argue this point, particularly if their contracts, many of which have been seen, define their limits of responsibility.

But because they are the principal in the 'contract' and put up the signs/rules and retain the right to sue the person, THEY are the service provider, same as the landowner is by painting the tarmac.

The PPC provide consideration (the space). They make the offer, not the landowner.

There is absolutely no doubt in my mind, both are service providers.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We will have to agree to differ.
  • I was on the way back home from a particularly daunting medical exam in Manchester..... stuck in peak traffic and I desperately needing the loo. Long story short; Pulled in at Manchester Fort on the brink of loosing my bowels.
My wife helped me out of the car and I dived into a well known coffee house and asked to use their loo......my wife then left me and returned to the car to find a present on the window.....4 min's 5 tops from Horizon Parking.
It appears that in the confusion one of us knocked the Blue badge off the dash...probably me with my sticks....don't know for sure......it was there....in plain sight......just not in the window....£80 to spend a penny.....what do I do? Fight it or pay it.
A footnote here......i was a bit late to the loo......so s**t day all round
