Engagement Ring Bought in Walmart Orlando

Hi,

We bought a Diamond engagement ring last July on Holiday in Florida. It was'nt cheap even though it was from Walmart.

Last week my girlfriend was devastated when one of the Diamonds fell out. We could not find it anywhere and took it to a Specalist Jewlery repair in Glasgow, who have said that the ring is not repairable.

The reason for this is the way the diamonds are meant to lock into place with each other, cannot be redone with a new diamond. The jewler has said that it is a fault with the design of the ring.

We bought using our credit card. Is There anything we can do as Walmart are saying its a 90 day returns policy.

Does the US have a sale of goods act? As I would expect a $800 dollar ring to last longer than five months.

Could we claim the credit card company?

    You can try to do a chargeback on your credit card?
    Gone ... or have I?
  • if you spent over £100 (and on your cc) you are still covered against the credit card company under s75 of the consumer credit act ie you are protected by the sale of goods act against the cc co. Don't be fobbed off, they'll say it isn't applicable to goods bought abroad but it is.

    What happened to it for one of the diamonds to fall out?
  • That is expensive for Wal-Mart! You should never buy a diamond in the same shop you can buy a gun, toilet paper and Pringles.
  • I don't know about the WalMart situation, but if the worst comes to the worst could you not have the rest of the diamonds (assuming it contained more than one) taken out and made into a new ring?
