Question regarding council list and end of private tenancy

Hi.
I’ve just separated from my partner and have two children. Upto then we’d been private renting on a joint tenancy agreement. He’s left and I can’t afford the high rent (no money from him) so applied for council housing (Scotland) but was told because my name is on the agreement I miss out on certain points for housing and would have a very long wait.
If I tell my landlord I can no longer afford to live here in my own and need to end the tenancy, will it be classed as intentionally making myself homeless? So would I then not get help from the council? I’ve no idea how all this works and would love any advice, thanks. :(

    If you give notice to end the tenancy as required under your STA then you are making yourself intentionally homeless. Your LL would have to apply for eviction on legal grounds, such as arrears of rent. That would qualify you for emergency accommodation once evicted.
    Your ex remains jointly liable for the rent if it is a joint tenancy until notice is given and served.
    Why is your ex unable to provide any payment for maintenance of his children-what financial agreement, if any, has been reached?
    Have you considered taking a lodger, if the property is suitable, and the LL agrees?

  • If you are working, it looks like the property you are renting is not sustainable and will have to move to a cheaper place, even if you have to get a loan to cover the costs of moving.

    If you aren't, you might be able to get a discretionary payment from the council (if your council runs such a scheme), but you will have to ask them.

    Check you are applying for all the benefits you can get, if you can get any. Go on the debtfree wannabe board to see if you can cut some expenses.
  • He has gone off to England and is barley communicating. As far as I’m aware he’s ‘not earning enough to pay anything’ (believe me I’ve been very vocal to him about this) :mad:
    I work but don’t earn enough by far to pay solo.

    That is not a sufficient excuse for not paying anything at all in maintenance.You need to get legal advice on this.
    He remains jointly and severally liable for the rent, whether he lives in the property or not.

  • Thanks, it’s good to hear someone else’s advice on this as I don’t have family close by. I will look into it :)
