Letting agent issue - help needed please

I wonder if I could get some advice please. My daughter and her boyfriend were due to vacate their rented flat on the 26th May. The letting agent contacted them and asked them if they would mind vacating earlier as they had a new tenant who wished to move in quickly. My daughter and her boyfriend agreed on the 26th April and have been organising and cleaning to facilitate this. Today, my daughter had an email from the agent stating that the new tenants had pulled out and they will now check them out on the original date of the 26th May because the landlord doesn’t want to lose a whole months rent. This isn’t fair in my eyes at all, they agreed a new date and should stick to it. It means that my daughter and her boyfriend will lose out on £500 of rent as they are now out of the flat as they had to move at the weekend due to work commitments. It also means that they may have to potentially clean all the windows and cut the grass again. I have worked for hours over the last few days to get the flat spic and span for her check out let alone the hours her and her boyfriend have put in. Can the agent do this? Where can they get advice and support from? Does anyone have any advice for me to pass to her, she is at her wits end. Thanks

    Have they spoken to the LL about this?

    Yes they have a letter stating the new date and my daughter has no contact with landlord ( lives overseas) only letting agent.

    this probably hinges on the wording of the letter - if the letter was clear agreement that the date has been varied, then the landlord cannot simply unagree that. If it was more vague / conditioned then its more murky.

    can you cut and paste the extract from the letter?

    Make sure you go back and take pictures of the property, and how clean it is. That there is no damage etc.

    I don’t know how to do that, I have an image of the letter with details blacked out, could I pm you it?

    Just quote here exactly what the letter says.


    Basically if a date to end the tenancy was clearly agreed by both sides, then it can only be changed again (ie back to the original end date) if both sides agree.


    But if there is any disagreement about what was agreed then the wording becomes critical as evidence of the agreement.

    “We write to confirm that you will be vacating the property on the 25th April 2019 and that the Inventory check out has been arranged for 9am on the 26th April 2019.” It then goes on to talk about removing personal belonging and check out lists and making sure the standing order to the landlord has been cancelled other wise they will
    Charge if they have to refund money.

    Sounds like a clear agreement to end the tenancy on 25th April.


    When did you last pay rent and what period did that rent payment cover?

    Just waiting for my daughter to give me the info on the rent, thanks for the advice re the agreement, that’s what we thought but we are
