Hi all some help appreciated please!

I used Prindo.co.uk an online printer/ink shop based in Germany in February 2019 and ordered black and coloured ink for my printer.

The black cartridge was defective. I contacted them and initially there was a bit of back and forth and then they asked for my serial number of my printer (which was odd). They sent out black ink 2 weeks after my initial order and I had to chase them to ensure it was sent so I was a little fed up at this stage.

They said they would send out a returns note to send back the defective. Nothing came so I disposed of the defective cartridge.

Last week (April 18th) I receive an email saying we have not received the cartridge. I replied saying you didn’t send out the returns note (I wasn’t going to pay for something defective going back to Germany) and that it has been almost two months so I disposed of it. They replied today by merely sending me an invoice. I replied stating the above again and they replied saying the email dating 1/3/19 had details of the returns note. I forwarded this email to prove they hadn’t sent it. They replied saying check your spam. I said all checked and I don’t see why I should pay for a defective item. They replied saying the invoice stands and email them for any other questions.

Where do I stand guys?!

    You stand under German laws.
    personally i would just ignore .

    As it stands you owe them the cartridge or its value, but I doubt anything will come of it if you do nothing.

    By disposing of the faulty goods you have also accepted them and taken ownership of them and therefore you do need to pay for them.


    However, you could probably wait it out and see if they take court action and take your chances arguing that you gave them more than reasonable opportunity to collect them and that you took their silence on the issue to mean that they had no further interest in their contractual obligations.
    (Although I could be wrong, I often am.)
