Presumably your contract doesn't give you the option of walking away because you've changed your mind though? Otherwise it would be a fairly pointless contract. I would expect you'd still be liable for all of the developers' costs in remarketing the property (potentially a hefty loss if they don't achieve the same price). But you've seen your contract, and we haven't.the thing is we haven't actually put a deposit down yet as we are using help to buy. This is why I am posing the question.0 -

As it is a new build I would have expected that they will have exchanged contracts.
It is possible they have exchanged with deposit from the builder irva nominal amount.0 -

I have contacted my solicitors who have put in writing to persimmon to put a fence up/trees or something just to block off the estate from the public footpath.0 -
They are putting up "something", there's a planting scheme in the approved planning drawings. It's hardly likely they're going to go through the process of seeking an amendment to the planning and erecting a fence along the whole boundary of the estate just to please you, especially if you're already locked into buying the house as it is.I have contacted my solicitors who have put in writing to persimmon to put a fence up/trees or something just to block off the estate from the public footpath.0 -

Just because you haven't put the deposit down (yet) doesn't mean you're not liable for it if you pull out :eek:
As for your solicitor writing to Persimmon 'telling' them to put a fence up :rotfl: - you do realise how little influence over this you or your solicitor have now that contracts have been exchanged
I refer back to my previous post - you need to rein in your expectations or have some very deep pockets0
