ANPR parking ticket

Hi all , I have received a parking ticket from Napier for parking in a ANPR parking zone . It’s my wife who was driving and when paying for the car park she entered the number 0 instead of the letter 0 , the machine went in to charge her £0.50 and she thought it’s all good and paid for . I only realised this when I appealed providing my ticket and the came back saying that I ha r entered the VRN wrong so I’m liable to pay the fine .
I appealed to the ias , insisting that I i have tried to pay and the if an error was made, the machine should have rejected my VRN and I could have possibly corrected my self , but the fact that the machine accepted my VRN and proceeded to ask me for money I thought it’s all good . So basically I have said as much as it’s my fault it’s also the machine that has caused the problem .
I would like to ask whether I have a case to fight and the success rate , as I believe it’s very unfair .
Thanks in advance

Of course it's unfair but that doesn't matter to the scamming PPC's they just want money and that's how they make it.
It's not a fine it's an invoice, which only a judge can make you pay, and the 0 o scam is generally seen as just that a scam.
The correct fee was paid and a tiny error was made a judge would probably see this as a waste of courts time.
Pity you didn't come here first appealing to the IAS is a waste of time, they are all part of the fiddle.
You are in waiting mode now to see if they issue a small claim, but it is winnable with help from here.

Hang on, you appealed to the IAS about a 'O' and.or '0' keypad error?
Don't tell us the IAS rejected that? See the IAS Annual Report:

These sorts of recommendations are an adjudicator’s opinion and may ask a parking operator to reconsider their position in certain situations. For example, the IAS has asked parking operators to reconsider innocent typographical errors like mistaking a “0” for an “O”, when a motorist enters their car registration number at a parking kiosk.PRIVATE 'PCN'? Thank you all for the response, and sorry for late reply. I have now received the decision back from the ias, in which the have dismissed my appeal , so either I have to wait until I’m taken to court or pay £100.00 .
My dilemma is whether I have any chance of winning at court or not ? Or maybe just pay . I just fill very cheated and it seems very unfair .0 -
The other thing I would want to know is if I loose in court , how much would my total bill will be ? Thanks in advance0

What happened when you complained to the landowner?
Have you complained to your MP about this unregulated scam?
If you lost in court it would cost about£175-200, but if you won you would get about £95 in costs.
A small keyboard mistake is a very minor error. O and 0 are next to each other on a my pooter keyboard and it is an easy mistake to make. Add in that the IAS annual report actually mentions this specific minor error, and these two letter are identical on a UK number plate.
The P & D software is flawed in that it allows motorists to enter the VRN of a vehicle that is not in the car park. Any decent computer programmer could easily eliminate that problem, but the scammers won't because these tiny errors generate an income.
I don't know if it would get to court, but I think you would have a good chance of winning if it did.
However, make the complaints first. You could also warn others via local press and social media about this scam, especially if there is a website or fakebook page for the location.
Our MPs have just passed a new parking bill which is designed to stop exactly this sort of disgusting behaviour from these scammers (MPs own words in open parliament).I married my cousin. so either I have to wait until I’m taken to court or pay £100.00 .
Well, that is a no brainer. IMO they would be daff to go to court on this as they would almost certainly lose, and would open themselves to a request for unreasonable behaviour costs under CPR27.14(2)(g).
They are obviously trying to scam you so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
Report the IAS to the IPC for ignoring the IPC's directive about '0' or 'O' keypad entries.
I am not joking. complain to the IPC (you can't email them, your have to 'register'.I would want to know is if I loose in court , how much would my total bill will be ?
Stop this by nipping it in the bud. Hilarious to complain to the IPC about IAS!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
