Order to attend court for questioning???

please help,a man knocked on our door and gave me a court letter saying i have to attend the county court on may 7th.
the letter says a judgment or order made on 31st January 2013 at the county court business centre to pay £8000 and i have to attend or i could go to prison for contempt of court.

In the past we have had loan problems which i saw citizens advice about and made payments,
I have no real recollection of what this is for its been over 6 years,it says its from IND ltd,i asked the guy and he says its to do with welcome finance,which does ring a bell,but we moved to this property around 7 years ago and i dont believe we have had any letters and i don think ive made any payments.

My wife has anxiety and depression,i am working but also on universal credit and barely managing i am very worried please can someone help,

  • I suggest some urgent advice from one of the debt charities or CAB is needed. Contact them ASPA.

    If there's been a CCJ then the six-year rule doesn't apply.

  • Contact the court and confirm what it’s about.
    Also check your credit files for any listed CCJ’s

    If it turns out there is a judgement and you do owe the money, there wouid generally be the opportunity to submit a budget to show what you can afford and to agree a repayment plan.
    All shall be well, and all shall be well, and all manner of things shall be well.

    Some things (like this) require concrete advice from people paid to give it you, not just the advice from people kind enough on the web to try and assist :)

    Given your circumstances I would just go to court- a judge is likely to be more sympathetic to your cause than a creditor and the repayment terms would likely be better than any sort of plan you can get the creditor to agree to.

    Either way if you owe the money you'll end up paying it back whether that be as part of a CCJ repayment plan or a plan agreed with the creditors. If you already have a CCJ then what have you to lose?

    BTW the court hearing is nothing to worry about, it's not like a proper court trial with jury and everything :)

    Before you do anything though contact a debt charity - they'll deal with thousands of these exact queries a month and are much better qualified to offer sound advice - everyone's situation is different and we can only go off what we have experienced or read about.

  • such kind and thoughtful replies on here,thank you,i should say the ccj was in january 2013,so is that far enough back for it to be statute barred or dosent that count with a ccj...thanks again.
