Sorry this is so long, I have tried to make it as short as possible
I purchased a PC on 10th November 2018, it developed a fault on 25th March 2019, contacted tech team, went through diagnostics then told to download on a different PC to usb and install the OS (Windows 10) if this didn't work take it into the store to be sent for repair. It didn't work as saying it wouldn't find relevant details, my son tried to recover my data from the Hard drive but found it corrupt and the files where empty, took it to the store on 27th March to be sent off, they phoned that evening saying it was a software fault as they had done the diagnostics and hardware showed OK, this was in store not at repair centre, and that as the Manufacturer doesn't cover software I would need to pay £60 to fix it, I explained that it was only just over 4 months old and as the seller my guarantee is with them, they wouldn't have it, so I messaged on Facebook and after arguing all day on 28th March, finally got someone talking sense and said that the store should not have asked me to pay, and that it would be sent.
I waited until 8th and phoned the store, they said they phoned me on 28th March, 2nd April and 8th April and said I should have answered my phone!!! the PC had not been sent out as I refused to pay the £60. I phoned the service department and they said they shouldn't have said what the fault was without them having a look, so he arranged to pick it up from me, I went to the store to collect it and had a word with the Manager, she also insisted that the warranty is with the Manufacturer and I would have to pay!!
They collected the PC on 11th April, on 14th had a message saying they where sending it back as it needs to goto HP as they need to repair it, I phoned the department and they said I would need to take it in the store to be sent, he also said to give them the reference number, and that would tell them that it needed to got to HP as they didn't think it was a software fault, it should have been delivered to me on 16th but didn't arrive. finally got it back on 19th, during all this time I was arguing again with the team on Facebook, I then messaged and said that I would be taking iit into the store and asked for his assurance that they would not mess me about again, he said he had sent them an email, so I went to the store. I was in there for quite a while as the assistant couldn't find out how to send it straight to HP, she gave me a docket and said she would call me later, I did get a call saying as it was a software fault I would have to pay, so back to day one :(
Once again got intouch on FB, they now are offering to pay the £60 to fix the 'Software Fault' (not confirmed) this is the same person who said I didn't need to pay on 28th March. Tomorrow will be 28 days since I took it in for repair, and I have been told by their service department that I am entitle to replacement by my consumer rights (I can't find though where it states that) but when I talk to the team on Facebook or email (it is the same people) I am getting no where, this PC can not be sent off until tomorrow because of the holiday and then could take 710days. I refuse to accept that I have to pay or have to allow them to pay the £60 but I have not stopped then from sending it for repair, I even collected it and sent it off to their service department which the store would not do.
I have told them all about the Consumer rights act and the rules about products under 6 months old but they are not listening, trouble is I am wondering how many other customers they have extorted £60 out of saying they are not covered and if this is endemic in all their stores as the Help team on Facebook don't even seem to know the law.
Any help pointing out where I can go with this or show me where the 28 day thing is I would be very grateful, I have wasted so much time searching my rights and getting nowhere with them.
Once again sorry this is so long but this is not even half of it.

    What software is causing the issue?

    Also I'm confused with the dates. You say it's been 28 days yet also say it was collected on the 11th April. Which is it?
  • I originally took it in on27th March for repair, as they would not send it off unless I paid, I had to fetch it and send it myself.
    Pretty sure it's not a software problem as all the files are corrupt, but they never sent off to find out just did the tests in the store, but obviously didn't try to re install the OS.
    They have now said they will give me a refund , after saying that they would no longer help me if I went to Trading Standards

    Afternoon, just out of curiosity how exactly did you son try to recover the data? how did you find out that the files were corrupt?

    is the machine not booting up or does it boot with some other type of error?

    What was this original fault ??

    Manufacturers do not cover Software but the Seller does, they admitted to me that they do

    A software problem that corrupts files?

    It's unlikely a large computer manufacturer, such as HP, would install such software on their machines.

    I'd guess you've inadvertently installed a malicious program.

    This sort of thing isn't usually covered by a guarantee; or consumer law.

    I suspect the remedy will be to repair or reinstall windows, which are things you can do yourself.

    Settings -> Update & Security -> Recovery offers some options.
