Hi, just as an update. After much back and forth correspondence with London Travelwatch and a letter to my MP, Rail Delivery Group have admitted that my interpretation of the penalty fares regulation was correct and this was also published in national media. https://www.itv.com/news/2019-08-21/thousands-of-rail-passengers-overcharged-for-not-having-valid-ticket/0

Not my original argument. It was an argument concerning the value of the penalty fare, which I asked about on the uk rail forum which specified that a penalty fare should be £20 or twice the single fare applicable, whichever is greater, where the full single fare applicable is determined by the day and time the journey was made.0
