What does a S21 look like?

Hello,

Ok here goes my first post on any type of forum. Have recently moved into a rented flat and after reading some horror stories on this site took out all my paper work from the LA. My main concern is that I have been issued with a S21 - does this have to be a seperate document?

The only part of the contact that makes no sense is the following:

"The Landlord further gives Notice to the Tenat that the Landlord may be entitles to possession of the Property on Ground 8 in Part 1 of Schedule 2 of the Housing Act 1988 or any of the Grounds in Part 2 of that Schedule (other than Ground 9 or Ground 16)" - Can anyone translate this into English please?

My other question is this if I have not been issued with a S21 and my Assured Shorthold Tenancy expires on 24/02/08 do I have to re-sign a contract? I am sure the letting agency will send me one, what happens if I don't sign? They charged 235 (pounds sorry can not find pound sign on keyboard!) for sending 2 e-mails and doing 2 credit checks so I am sure it will cost a fair amount to re-new the contract.

    This is a basic part of a tenancy agreement and relates to the fact the athe landlord may issue a s8 notice if you breech your tenancy agreement grounds 1 - 8 are madetory and if you breech them and the landlord can prove it the court would have to grant possession if the landlord was to apply for it.

    grounds 9 - 16 are discretionary so that if the landlord relies on these to obtain poseesion, he also has to prove that it would be reasonable for the court to grant outright possession .

    A section 8 noticce can be used at any time even during the fixed tem of the tenancy if you have breeched the tenancy agreement.

    At he end of your 6 month fixed term if the landlord does not issue you with a new tenancy agreement your tenancy becomes a periodic assured shorthold, after this time your landlord would have to issue you with a valid s21 notice giving you 2 months notice if he wished to regain possession and you had not breeched the tenancy agreement.

    if you have not got anything other than this i would say you have not been served a s21
    it would have s21 of housing act 1988 on the top.
  • I have not got one of those. So that is good news when the EA contact us in February with a stupid amount of money to re-new the contact I tell them to go and take a running jump! Will also contact LL and ask him if he would be interested in renting privately.
